1. Acceptance of Terms

By downloading, installing, or using the LUNA - AI Art Generator application ("App") or accessing the website at www.lunaartapp.com ("Website"), collectively referred to as the "Service," you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by Rocket Digital Limited, located at 1603, The L Plaza, 367-375 Queens Road Central, Hong Kong.

2. Description of Service

LUNA is an AI art generator application that allows users to create digital artwork using artificial intelligence models. The Service includes but is not limited to:

  • Text-to-image generation using various AI models
  • Photo transformation and style transfer
  • AI portrait and avatar generation
  • Image upscaling and enhancement
  • Access to a gallery of community-created artwork

3. Account Registration

You may be required to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration and keep it updated.

4. Subscriptions and Payments

LUNA offers both free and premium subscription plans. Premium subscriptions are processed through the Apple App Store or Google Play Store, with payment management handled by RevenueCat.

  • Subscriptions automatically renew unless cancelled before the renewal date
  • You can manage or cancel subscriptions through your App Store or Google Play account settings
  • Refunds are handled according to the policies of Apple or Google, as applicable
  • We reserve the right to change subscription pricing with reasonable notice
  • Free credits or trial periods may be offered and can be modified or discontinued at our discretion

5. User Content and Conduct

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Create content that infringes on intellectual property rights of others
  • Generate deepfakes or misleading content intended to deceive
  • Produce content depicting minors in inappropriate situations
  • Attempt to reverse-engineer, decompile, or extract the AI models
  • Use automated systems to access the Service beyond normal usage
  • Circumvent any rate limits, access controls, or security features
  • Resell or redistribute AI-generated content as a competing service

We reserve the right to remove content and suspend or terminate accounts that violate these Terms without prior notice.

6. Intellectual Property

6.1 Your Generated Content

Subject to compliance with these Terms, you retain rights to the images you generate using the Service. You may use generated images for personal and commercial purposes. However, we make no guarantees regarding the uniqueness or originality of generated content, and similar outputs may be generated for other users.

6.2 Our Intellectual Property

The Service, including its design, features, code, and branding, is owned by Rocket Digital Limited and protected by intellectual property laws. The LUNA name, logo, and associated trademarks are our property.

6.3 License to Use Generated Content

By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce your generated content for the purposes of operating, promoting, and improving the Service (e.g., featuring in a public gallery or marketing materials), unless you opt out of public sharing.

7. Third-Party Services

The Service relies on third-party providers for various functionalities:

  • RevenueCat: Subscription and payment management
  • Firebase: Authentication, storage, and analytics
  • Google AdMob: In-app advertising
  • OpenAI: AI model access for image generation
  • Microsoft Azure: Cloud infrastructure and AI services
  • Replicate: AI model hosting and inference
  • Fal.ai: AI model inference services
  • Google Analytics: Website analytics
  • Meta Pixel: Advertising analytics

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, error-free, or secure
  • Generated content will meet your specific requirements or expectations
  • AI models will always be available or produce consistent results
  • The quality, accuracy, or reliability of any generated content

AI-generated content may contain inaccuracies, artifacts, or unintended elements. You are responsible for reviewing and validating all generated content before use.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROCKET DIGITAL LIMITED AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Rocket Digital Limited from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by contacting us at hello@rocketdigital.ai.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or Website. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
